By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. About the Service
Fiabalo is a digital storytelling platform that provides audio and reading content designed for children. The Service itself is intended exclusively for parents and legal guardians who manage accounts and access content on behalf of their children.
2. Eligibility
- You must be at least 18 years old to use the Service.
- You confirm that you are a parent or legal guardian.
- Children are not permitted to create accounts or use the Service independently.
3. Accounts and Responsibility
- Your account is personal and may not be shared with others.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms, applicable laws, or misuse the Service.
4. Child Profiles
You may optionally create child profiles to personalize the Service.
Any child-related information is provided voluntarily by you as a parent or legal guardian and remains under your control.
Child profiles are part of the parent account and are used solely to personalize content within the Service.
5. Free Trial
Fiabalo may offer a 7-day free trial that allows new users to access selected parts of the Service at no cost.
During the free trial:
- Access is limited to a selected subset of stories and features.
- Certain content and features, including but not limited to coloring pages, premium stories, and advanced functionality, are not available.
- No payment method is required to start the free trial.
At the end of the free trial:
- Your access to the Service will be blocked.
- You will not be charged automatically.
Access will remain blocked unless you actively choose to start a paid subscription.
6. Paid Subscriptions, Billing, and Auto-Renewal
Fiabalo offers paid subscriptions on a monthly or annual billing basis (each a “Subscription”), purchased through the website.
When you start a Subscription:
- You will be charged the applicable fee at the beginning of each billing period.
- Your Subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date.
- Payments are processed by our third-party payment provider, Stripe.
You may cancel your Subscription at any time through your account settings.
If you cancel:
- Your access will remain active until the end of the current billing period.
- No further charges will be made after cancellation.
Except where required by applicable law, subscription fees are non-refundable.
7. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes
- Attempt to gain unauthorized access to the Service or its systems
- Copy, distribute, or resell content without authorization
- Interfere with or disrupt the Service
8. Intellectual Property
All content, software, text, audio, illustrations, and trademarks available through the Service are owned by or licensed to WEB DEV s. r. o., except where explicitly stated otherwise.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.
Nothing in these Terms grants you ownership rights in any content or intellectual property.
9. Service Availability
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation.
We may modify, suspend, or discontinue any part of the Service at any time.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
11. Limitation of Liability
To the maximum extent permitted by law, WEB DEV s. r. o. shall not be liable for indirect, incidental, consequential, or special damages.
Our total liability shall not exceed the amount paid by you to us during the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless WEB DEV s. r. o. from claims arising out of your use of the Service or violation of these Terms.
13. Termination and Account Deletion
You may request deletion of your account at any time.
All account deletion requests must be submitted by email from the email address associated with your account to: [email protected].
We may require reasonable verification of your identity before completing the request.
We may suspend or terminate your access to the Service if you violate these Terms, applicable laws, or misuse the Service.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic.
If you are a consumer, mandatory consumer protection laws of your country of residence may also apply.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Service, applicable laws, or our business practices.
When we make material changes, we will provide reasonable notice by updating the “Last updated” date on this page and, where appropriate, by notifying you via email or through the Service.
Changes will apply only on a prospective basis and will not apply retroactively unless required by law.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the revised Terms.
